Information We Collect
Account & contact: name, email, phone, business details, billing/payment info (processed by our payment provider; we do not store full card data).
Service data: user inputs, chat/voice conversations, uploaded files, configuration, logs.
Technical: IP, device/browser, timestamps, cookies (essential), error logs.

Provide & support services (perform the contract).
Operate, secure, and troubleshoot (legitimate interests).
Improve AI performance using conversation data (legitimate interests; see “AI handling”).

AI-Specific Handling
We may use anonymised/aggregated conversation data to improve prompts, workflows and model performance.
We do not use your content to train third-party foundation models beyond each vendor’s own policies. OpenAI/xAI (Grok) may process/retain data under their terms; we configure provider settings to limit retention where possible.
You can opt out of BoldSwitch using your content for internal model/prompt improvement by emailing [email protected] (this may reduce service quality).
Sharing & Sub-processors
GoHighLevel (GHL), OpenAI, xAI (Grok), Twilio (telephony/SMS).
Payment processor (via GHL/Stripe if enabled).
Cloud hosting, email, and support tools as necessary. We bind vendors by data-processing terms.
International Transfers
Your data may be processed outside the UK/EEA. We use SCCs/UK IDTA and vendor safeguards (e.g., DPF participation where applicable).
Security
Encryption in transit, access controls, MFA on admin tools, least-privilege access, logging, and vendor due diligence. No method is 100% secure.
Retention
We keep data for the life of your account and delete within 30 days of verified deletion request; limited backups may persist up to 180 days then roll off. Billing records kept 6 years (UK law).
Your Rights
Access, rectification, erasure, portability, restrict/obj ect processing, withdraw consent, and lodge a complaint with the ICO.

1) Services
We provide AI automation services (e.g., chatbots, voice/WhatsApp agents, appointment setters, follow-up automations, integrations, and related consulting) delivered via our platform and approved third-party providers (GHL, OpenAI, xAI/Grok, Twilio).
2) Eligibility & Accounts
Business use; 18+. You’re responsible for safeguarding logins and ensuring lawful use.
3) Orders, Fees, and Cancellations
Fees, billing periods, and any trials are shown in your order/checkout. Subscriptions bill in advance and renew until cancelled; cancellation takes effect at the end of the current term. Unless required by law, no refunds for partial periods or completed services.
4) Acceptable Use
No illegal, harmful, misleading, infringing, or high-risk uses (e.g., harassment, spam, scraping without consent, malware, biometric or medical decisions). No sensitive personal data unless we agree in writing and a DPA is in place.
5) AI Outputs & Your Content
Your content: you own it. You grant us a limited licence to process it to provide the services and for security/diagnostics.
AI outputs: upon payment, we assign to you our rights in generated outputs to the extent permitted by law and vendor terms; we retain rights in our templates, prompts, and tooling.
You are responsible for reviewing outputs and for compliance with law and platform rules.
6) Third-Party Services
Use of GHL, OpenAI, xAI/Grok, Twilio, and any payment/hosting/analytics tools is subject to their terms and policies. We are not liable for their acts/omissions.
7) Data Protection & Privacy
We process personal data per our Privacy Policy (above). International transfers rely on SCCs/UK IDTA where applicable. You must provide lawful bases and notices to your end-users.
8) Service Changes & Availability
We may modify features, apply fair-use limits, or suspend services for security, legal, or non-payment reasons. We aim for high availability but do not guarantee uninterrupted service.
9) Warranties & Disclaimers
Services and AI outputs are provided “as is”. We disclaim implied warranties to the fullest extent permitted by law. AI may produce errors; you should validate critical results.
10) Limitation of Liability
To the maximum extent permitted, our total liability for all claims in any 12-month period is limited to the fees you paid to us in that period; we are not liable for indirect, consequential, or special damages.
11) Indemnities
You will indemnify us against claims arising from your content, unlawful use, or breach of these Terms. We will indemnify you for claims that our proprietary software (excluding your content/third-party tools) infringes IP, subject to standard conditions.
12) Termination
Either party may terminate for convenience (end of current term) or immediately for material breach. On termination, your access ends; we will delete/return your data per the Privacy Policy. Outstanding fees remain due.
13) Changes to Terms
We may update these Terms; we’ll notify you for material changes. Continued use after the effective date constitutes acceptance.
